What is a compliance certificate?

A swimming pool compliance certificate is official confirmation that your pool barrier meets the safety requirements of the Swimming Pools Act 1992 (NSW) and Swimming Pools Regulation 2018. It is mandatory for selling or leasing a property with a pool or spa.

Our accredited certifiers carry out thorough inspections against Australian Standard AS 1926.1-2012 and issue certificates directly through the NSW Swimming Pool Register.

Our certified inspectors assess every element of your pool barrier against current NSW legislation and Australian Standards.

  • Pool fence and barrier height compliance
  • Gap sizes between palings and below fence
  • Self-closing, self-latching gate with correct outward opening
  • Non-climbable zones (900mm outside, 300mm inside)
  • Barrier condition — no damage, corrosion or weakness
  • No climbable objects near barrier
  • Direct building access points to pool area
  • CPR signage posted in a prominent poolside position

Requirements

When do you need a
compliance certificate?

Selling Your Property

A Certificate of Compliance (or Non-Compliance) and proof of registration must be attached to the Contract for Sale.

Renting Your Property

Landlords must provide a valid Certificate of Compliance to the tenant at the time of entering into a residential tenancy agreement.

Expired Certificate

Certificates are valid for 3 years. If yours has expired — particularly before a sale or lease — you need a new inspection.

Following Renovation

If your pool barrier, fence, house or yard has been modified, previous compliance exemptions cease and current standards apply.

Visitor Accommodation

Properties with tourist accommodation or more than 2 dwellings are subject to a mandatory council inspection program.

New Pools

After a new pool or spa is installed, a relevant occupation certificate is required. Once expired, a formal compliance inspection is needed.

What is a Swimming Pool Certificate of Compliance?

A Certificate of Compliance is an official document confirming that your pool or spa barrier meets the safety requirements of the Swimming Pools Act 1992 (NSW), the Swimming Pools Regulation 2018, and Australian Standard AS 1926.1-2012. It is valid for 3 years from the date of issue.

What does a pool barrier inspection involve?

Our inspector assesses the entire pool barrier — including fence height and condition, gate mechanisms, non-climbable zones, gap sizes, climbable objects, direct building access points, and CPR signage. Most inspections take 1–2 hours on site.

Do I need a Certificate to sell or rent my property?

Yes. If you are selling a property with a pool or spa in NSW, the contract for sale must include a valid certificate or proof of pool registration. For rentals, a valid certificate must be provided before the lease begins.

What happens if my pool fails the inspection?

We issue a written notice under section 22E and a Certificate of Non-Compliance within 7 days. You then have 6 weeks to rectify the issues and arrange a re-inspection. If not resolved, we notify your local council.

How long is a Certificate valid for?

3 years from the date of issue, provided no directions are issued against the pool under section 23 of the Act in the interim.

Does my spa or inflatable pool need a certificate?

Yes, in most cases. The Act applies to any pool, spa or vessel capable of being filled to a depth greater than 30cm. This includes spa pools, hot tubs, swim spas, above-ground and portable pools.

Which Australian Standard applies to my pool?

It depends on when your pool was built. NSW recognises AS 1926-1986 (before 1 Sep 2008), AS 1926.1-2007 (1 Sep 2008 – 30 Apr 2013), and AS 1926.1-2012 (from 1 May 2013). If the barrier has been modified, the current standard applies.

Can I sell with a non-compliant pool?

Yes, provided a Certificate of Non-Compliance is attached to the contract for sale along with proof of registration. The buyer then has 90 days from settlement to rectify. However, obtaining compliance before listing is strongly recommended.
